EPITOLEDGE TERMS OF SERVICE

Effective from 1st January 2026

1. AGREEMENT

By using Epitoledge, you agree to these Terms.

If you do not agree, you must not use the Services.

2. ACCOUNT RESPONSIBILITIES

You agree to:

  • Provide accurate information
  • Maintain account security
  • Keep login credentials confidential
  • Accept responsibility for activity under your account

We may suspend accounts for violations.

3. SUBSCRIPTIONS & PAYMENTS

Subscriptions auto-renew unless canceled.

Payment is processed by third-party providers such as Paystack.

Upgrades take effect upon confirmed payment.

Downgrades occur upon subscription expiration.

Refunds are discretionary unless required by law.

Chargebacks or fraudulent payment disputes may result in termination.

4. USER CONTENT

You retain ownership of your uploaded content.

You grant Epitoledge a limited license to:

  • Store
  • Process
  • Display
  • Backup

You agree to indemnify Epitoledge for any claims arising from your content.

5. COPYRIGHT POLICY

We operate as a hosting provider.

If we receive valid copyright complaints, we may:

  • Remove allegedly infringing content
  • Suspend repeat infringers
  • Disclose information where legally required

Users are solely liable for uploaded copyrighted material.

6. ACCEPTABLE USE

You may not:

  • Upload illegal or pirated content
  • Upload malware
  • Violate intellectual property rights
  • Abuse AI systems
  • Attempt to bypass subscription controls
  • Reverse engineer the platform

We may terminate accounts for violations.

7. AI ASSISTANT

AI outputs:

  • Are automated
  • May contain errors
  • Do not constitute professional advice

You use AI features at your own risk.

8. ADVERTISING

Free-tier users may see ads delivered via Google AdSense.

We are not responsible for:

  • Advertiser claims
  • Third-party sites linked in ads
  • Products or services advertised

9. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

  • Uninterrupted service
  • Error-free performance
  • Data preservation beyond reasonable safeguards

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

We are not liable for:

  • Indirect or consequential damages
  • Loss of profits
  • Loss of data
  • User-uploaded content
  • AI outputs
  • Third-party advertising

Our total liability shall not exceed the greater of:

  • Amount paid by you in the previous 12 months
  • OR
  • USD $100 equivalent

11. INDEMNIFICATION

You agree to indemnify and hold harmless Epitoledge from claims arising from:

  • Your uploaded content
  • Copyright violations
  • Illegal activity
  • Breach of these Terms

12. GOVERNING LAW

These Terms are governed by the laws of Kenya.

Disputes shall be resolved through binding arbitration in Kenya unless prohibited by local consumer laws.

Class action participation is waived to the maximum extent permitted by law.

13. TERMINATION

We may suspend or terminate access for:

  • Violations of these Terms
  • Fraud
  • Abuse
  • Legal requirements

Certain provisions survive termination.

14. MODIFICATIONS

We may modify these Terms at any time. Continued use constitutes acceptance.
